Respected Board Members, Planning Commissioners, Director of the Planning and Building Department, and County Council,

On behalf of Los Osos Sustainability Group I hereby request that the County immediately cease and desist from accepting, processing and approving of any and all development and construction applications for water-using development within Los Osos. This urgent demand is based on clear and credible evidence, including documents we have obtained from the County, as well as documents the County has provided to the general public in connection with the proposed Los Osos Community Plan (LOCP) and Growth Management Ordinance (GMO), which collectively demonstrate that the current condition of the Los Osos Basin is unsustainable.

We also intend to appeal to the Coastal Commission all water-using development subject to the Coastal Commission’s jurisdiction that is currently under review, as well as any future water-using development under consideration by the County.  

Please forward this notification to all necessary departments and ask them to notify us of all related timelines and other pertinent information.

We are asking the County to immediately stop issuing new development permits in large part because the County has not and currently, cannot, establish that sufficient water supplies exist to support further development in Los Osos. Thus, approval of any water-using new development in Los Osos violates and/or fails to comply with Coastal Plan Policies (e.g., Public Works Policy 1 and Watershed Policies 1 and 2), Coastal Zone Land Use Ordinance (CZLUO) (e.g., Section 23.04.403), and Condition 6 of the Los Osos Wastewater Project (LOWWP) CDP (2010) as well as sound planning principles.

Unless the County promptly responds to this request, we will have no choice but to pursue litigation.
